Shirley beats FirstRock in court
Pierre Shirley, a former executive at FirstRock Group, has successfully won a legal case against his former employer after the court determined that the company failed to follow proper procedures to extend its claim against him.
The dispute began when FirstRock Group filed a claim against Shirley in October 2022, a year after his departure from the company, concerning an employee loan. However, the claim expired in April 2023. The company attempted to extend the validity of the claim through multiple court hearings, which were heard by different judges in May and November 2023.
In a ruling issued in October 2024, Justice Stephane Jackson-Haisley declared that any applications or orders related to the November 2023 hearings were void and without effect. She noted that the original claim form had not been validly renewed before its April 2023 expiration, leaving the court without jurisdiction to hear the matter.
Additionally, Justice Jackson-Haisley ordered that 70 per cent of the legal costs be borne by FirstRock Group.
In a related matter, Shirley had filed a claim in December 2023 seeking US$1.58 million in compensation from three FirstRock principals/executives, FirstRock Group, FirstRock Realty, and FirstRock Global Holdings. Shirley had indicated that any settlement from his claim should go towards settling a previous loan with FirstRock Group. However, that claim is currently marked as closed in the commercial registry of the Jamaica Supreme Court.
