Son gets probation for vandalising dad’s property
MONTEGO BAY, St James — A man who reportedly damaged a car window and three security cameras at his father’s house was given two years’ probation in the St James Parish Court on Wednesday.
Twenty-one-year-old Farm Heights resident Duan Rose pleaded guilty to malicious destruction of property.
On a previous mention date, presiding judge Natiesha Fairclough-Hylton expressed concern for Rose’s mental health, citing his consistent restlessness in the prisoner’s dock. She subsequently requested a psychiatric assessment; however, he was deemed fit to plead.
On Wednesday, during the mitigation phase, Rose’s attorney Kimika Peterkin stated that the incident was unintentional and that her client was willing to accept full responsibility for his behaviour.
“He has instructed me that he has apologised to his father and that he has all intention of replacing the items that were destroyed as soon as he is a position to do that,” Peterkin added.
The lawyer went on to say that her client admitted to having anger issues and expressed a sincere commitment to addressing and improving on these shortcomings, as well as a strong determination to prevent similar behaviour from occurring in the future.
Peterkin then requested that Rose be given a non-custodial sentence due to his youth and the promising future that awaits him.
In handing down her sentence, Fairclough-Hylton agreed that incarceration may not be the most appropriate punishment for Rose at this time. She noted that his apology to his father demonstrated his remorse.
The judge subsequently imposed a two-year probation sentence on the defendant, emphasising that he would be working with probation officers to receive guidance and avoid repeating criminal behaviour.
Allegations are that on August 5 at approximately 9:30 pm, the complainant heard a noise at his front gate. Upon investigating, he saw that Rose, who is his son, had thrown stones at his motor car and damaged the vehicle’s rear window.
The complainant reported the matter to the police and, when he returned home, discovered that three security cameras installed on his house were damaged.
The complainant told the court that the issue stemmed from Rose’s persistent refusal to cease smoking marijuana.
