Businessman freed of assault charges brought by wife
KINGSTON, Jamaica— A 54-year-old businessman was on Tuesday found not guilty of assault charges that were laid against him by his wife in March of 2021.
The verdict was handed down in the Corporate Area Criminal Court.
Allegations are that Benson Oguaka, while at the couple’s business place, had an argument with his wife. He reportedly punched her several times, causing her to fall to the ground.
However, Oguaka denied assaulting his wife.
At the end of the trial, the court found that the credibility of the wife had been completely shattered during cross-examination by Oguaka’s attorney, Peter Champagnie, KC.
The court noted that in one instance, the complainant had previously reported that the assault took place in the presence of one of their employees. However, when challenged as to the truth of her account by Champagnie, she sought to say that the employee was not actually present when the incident occurred but was present at the business place.
The employee testified that she was present during the argument between husband and wife but no assault took place.
During the trial, Champagnie pointed to the fact that there was an ongoing civil court case between the two to which the complainant admitted.
