Telecoms witness to continue testimony in Manchester fraud trial
MANDEVILLE, Manchester — A representative of one of the island’s telecommunication providers will return to the witness stand today, as the prosecution seeks to have her provide in her testimony the names of subscribers, which were supplied to the police, as evidence in the $400 million Manchester Municipal Corporation fraud.
The matter, which is being heard in the Manchester Parish Court by judge Ann Marie Grainger, yesterday had testimony from the Court Process Officer of the telecommunication company who stated that under the Jamaica’s Telecommunication’s Act, she provided the Major Organised Crime Agency (MOCA) with subscriber information on a number of persons supplied by MOCA.
The witness was provided with the statement she gave the police in order to refresh her memory as to the names of the people whose subscriber information was before the court. The witness eventually gave several names to the court, but when the prosecution enquired if there were more names, the witness said she could not recall.
Defence attorneys raised objections when an attempt was made by the prosecution to admit into evidence a document purportedly bearing all the names of the persons whose subscriber information was recorded. The objection was on the grounds that the computer generated document had no information regarding its author or other identifying features such as the date and was therefore not admissible.
At that point the adjournment was taken and the witness ordered to return to court today when the crown will resume examination of the witness.
Facing the court on multiple charges involving conspiracy to defraud the Municipal Corporation of some $400 million are the former deputy superintendent in charge of road and works Sanja Elliott, his wife Tasha Gay and his parents Edwardo and Myrtle Elliott. Also charged in the same matter are former employees of the Corporation, David Harris, and Kindale Roberts; former bank employee Radcliffe McLean and Dwayne Sibblies who is employed to Sanja Elliott.
