#BEIJING2015: IAAF writes CVM over use of World Champs footage
KINGSTON, Jamaica — The following is a letter sent to CVM Television from the International Association of Athletics Federations (IAAF). The IAAF said CVM has been using footage without observing correct protocols and has requested that CVM notify them of footage that has been used in an effort to clarify what licence fee is payable. See letter in full below.It has come to our attention that CVM Television (“CVM”) has been broadcasting excerpts of footage from the IAAF World Championships Beijing 2015 (“Event”) in programming within the territory of Jamaica, rights to which are exclusively held by Athletics Management & Services AG (“AMS”), which has been sub-licensed such rights by Dentsu Inc of Tokyo, Japan, the marketing partner of the International Association of Athletics Federations (“IAAF”). Such use requires the payment of a licence fee and the entering into of a clip licence agreement upon our standard terms. As such, we would request that you immediately notify us of what footage has been used to date so that we can clarify what licence fee is payable. All future use of any footage from the Event must be approved in writing by AMS. We would require that you do not transmit any further footage until this has been clarified. Notwithstanding the above, AMS reserves all rights in this regard. We look forward to hearing from you as a matter of urgency plus receiving your confirmation that you will not continue to use our footage without our express permission.
