Porteous withdraws election petition

PORTEUS... unsuccessfully contested the Central Manchester constituency seat.

THE Jamaica Labour Party's(JLP) Sally Porteous, who unsuccessfully contested the Central Manchester constituency seat in the September 3 general elections, on Monday withdrew her application for an election petition against her opponent, while two other petitions before the Supreme Court were adjourned.

Porteous, who filed the petition following her defeat by the People's National Party's (PNP) Peter Bunting, withdrew the application, which cited irregularity in the election, stating that it was not served in accordance with the Election Petition Act.

Meanwhile, the petition brought by the JLP's Barrington Gray against Dr Dk Duncan, the PNP's Member of Parliament for the East Hanover Constituency and that of the PNP's Oswest Senior Smith against the JLP, Shahine Robinson (North East St Ann) were adjourned.

The petition brought by Gray against Duncan was adjourned until December 18 when an application by Duncan's legal team to have the petition struck out will be heard.

Duncan's legal team had filed the application to have the petition struck out on the ground that Duncan was not served notice of Gray's action.

Gray's attorneys are, however, maintaining that Duncan was served and will furnish a detail of service to the court on December 18.

Senior-Smith's petition was adjourned pending the outcome of an election petition appeal by the PNP's Phyllis Mitchell against the JLP's Gregory Mair (North East St Catherine).

Mitchell, who lost the constituency to Mair, had filed an application for an election petition, but Mair claimed that he was improperly served while sitting in the chambers of Parliament and asked that the court strike out the petition.
Mitchell counted that the relevant documents were also served on Mair through registered mail. The court last month ruled in favour of Mair, prompting an appeal by Mitchell.
Robinson, too, is claiming that she was improperly served by Senior-Smith.
